Welcome to Fatafat Delivery! These Terms and Conditions ("Terms") govern your use of our website and mobile applications (collectively, the "Platform") and the services provided by Fatafat Delivery ("Fatafat," "we," or "us"). By accessing or using the Platform, you agree to these Terms and consent to the processing of your personal data as described in our Privacy Policy. If you do not agree to these Terms, please do not use the Platform or our services.

The Platform is intended for use by individuals who are at least 18 years old and by corporate entities. If you are under 18, you must obtain consent from your parent(s) or legal guardian(s) to use the Platform. Your parent(s) or legal guardian(s) will be responsible for your actions and any charges associated with your use of the Platform.

Fatafat may conduct background checks on users at any time without further notice. These checks may include but are not limited to, government or financial sanctions, civil or criminal litigation activities, and adverse news. If we are not satisfied with the results of these checks, we may terminate your account and/or use of the Platform.

We reserve the right to change or modify these Terms at any time. It is your responsibility to review these Terms regularly. Your continued use of the Platform following any changes constitutes acceptance of the revised Terms.

 

Who We Are:

Fatafat Delivery is a food delivery service operating in Hyderabad, Pakistan. Our mission is to provide fast and convenient food delivery services to our customers, connecting them with a variety of restaurants and eateries in their area.

What We Do:

Fatafat Delivery operates a platform that allows customers to place orders for food from participating restaurants and vendors. We facilitate the delivery of these orders to the customer's specified location in a timely manner.

Restrictions:

• Users must be at least 18 years old to use the Fatafat Delivery platform.
• Users must not use the platform for any unlawful or fraudulent activities.
• Users must not interfere with the proper functioning of the platform or attempt to access unauthorized areas of the platform.

Intellectual Property:

All intellectual property rights related to the Fatafat Delivery platform, including but not limited to trademarks, logos, and software, are owned by Fatafat Delivery. Users are not permitted to use or reproduce these intellectual property rights without prior written consent from Fatafat Delivery.

Orders:

• Orders can be placed through the Fatafat Delivery App available on Google Play Store and IOS store.
• Once an order is placed, it cannot be modified but you will have option to cancel the order within 15 seconds.
• Orders are subject to availability and confirmation from the restaurant or vendor.

Vendor Cancellation or Non-Acceptance: In the event that a vendor cancels or does not accept an order made through the Fatafat Delivery platform, customers who have paid online will receive a full refund of the amount paid, excluding delivery charges.
Customer Behavior: Fatafat Delivery reserves the right to cancel an order if a customer's behavior is deemed inappropriate or violates the platform's terms of service.
Order Delay: Fatafat Delivery reserves the right to cancel an order if it is significantly delayed beyond the estimated delivery time.
Pricing: Fatafat Delivery reserves the right to set the price for every food item available on the application. Prices may vary based on factors such as market conditions, vendor agreements, and operational costs.

Prices and Payments:

• Prices for food items and delivery charges are displayed on the Fatafat Delivery platform.
• Payments can be made online through the platform using a variety of payment methods.
• Prices are subject to change without prior notice.

Delivery Time:

• Estimated delivery times are provided on the Fatafat Delivery platform and are subject to change based on various factors such as traffic and weather conditions.
• Fatafat Delivery aims to deliver orders within the estimated delivery time but does not guarantee delivery within this time frame.

Order Cancellation if Customer Does Not Respond:

If a customer does not respond to a delivery attempt within 10 minutes, the order will be canceled, and no refund will be provided.

Limitation of Liability:

Fatafat Delivery is not liable for any damages, losses, or expenses incurred by users as a result of using the platform or the services provided by Fatafat Delivery, except where such liability cannot be excluded under applicable law check.

1. Issuance of Promotions    

Fatafat Delivery (“the Company”) may, at its sole discretion, release promotional offers, discount codes, coupons, or other incentives (“Promotions”) to selected or all users. The Company is under no obligation to issue Promotions and may withdraw or modify them at any time without prior notice.

2. Eligibility    

Promotions are valid only for the account, device, or phone number to which they are issued. They are non‑transferable, may not be sold or exchanged for cash, and cannot be combined with any other offer unless expressly stated.

3. Minimum & Maximum Cap

The Company reserves the right to set or change minimum‑spend thresholds and maximum discount limits for each Promotion without notice. Caps may differ between users, locations, or campaigns.

4. Validity Period

Each Promotion carries an explicit or implicit expiry date. Once expired, the Promotion cannot be reissued or extended. Orders must be placed and completed before the expiry to qualify.

5. Usage Limits    

Unless otherwise specified, a Promotion may be redeemed once per user. The Company may impose additional limits (e.g., per device, per payment method) to prevent misuse.

6. Excluded Items & Services

Promotions may exclude certain restaurants, menu items, delivery areas, or service fees. Exclusions are determined solely by the Company and may change without notice.

7. Order Adjustments & Cancellations

If an order using a Promotion is cancelled or adjusted, the discount value may be forfeited. The Company is not obliged to reinstate or replace any Promotion applied to a cancelled order.

8. Fraud Prevention

The Company monitors Promotion usage for signs of fraud or abuse. Suspected misuse may lead to order cancellation, Promotion removal, account suspension, or legal action.

9. No Cash Value

Promotions have no cash or exchange value and are not refundable. If the discount exceeds the order total, any remaining value is forfeited.

10. Amendments

The Company may amend these Promotion terms, or discontinue Promotions entirely, at any time. Continued use of Promotions after changes constitutes acceptance of the revised terms.

Termination:

Fatafat Delivery reserves the right to terminate or suspend access to the platform for any user who violates these terms and conditions or engages in any fraudulent or unlawful activities.

Governing Law:

These terms and conditions are governed by the laws of Pakistan, and any disputes arising from or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Pakistan.
